Understanding the Charges Against Albert Komen Kipkechem

Albert Komen Kipkechem has been charged before a Nairobi court with hacking into a company’s computer system and causing a financial loss of more than Sh52 million.

Albert Komen Kipkechem, also known as Jonathan Kiptum Barmasai, appeared in court facing charges of unauthorised access to a computer system and computer fraud contrary to the Computer Misuse and Cybercrimes Act.

The prosecution told the court that on diverse dates between June 6 and June 20, 2025, at an unknown place within the Republic of Kenya, the accused allegedly infringed the security measures of Eclectics International and gained access to the company’s computer system without authority with the intention of committing a further offence.

He is further accused of fraudulently causing a financial loss of Sh52,549,798 to the company through the unauthorised access.

Through an affidavit filed in court, Directorate of Criminal Investigations (DCI) officer Andrew Ngowa, attached to the Economic and Commercial Crimes Unit, said the accused poses a significant flight risk.

Ngowa told the court that although the accused is a Kenyan citizen, he is also a holder of a Democratic Republic of Congo passport.

The officer further stated that the alleged offences involve sophisticated cross-border cyber activities and that there is a high likelihood the accused may abscond if released.

According to the investigator, the accused was arrested on March 2, 2026, and was allegedly found in possession of eight national identity cards bearing his photograph but displaying different names and nationalities.

The prosecution argued that the possession of multiple identity documents demonstrates a calculated effort to conceal his identity and would make it difficult for the State to effectively monitor his movements if released.

Ngowa also told the court that investigations into other related incidents of computer fraud linked to the accused are ongoing and that his release could prejudice the inquiries.

The court further heard that the accused allegedly has the technical expertise to remotely access, encrypt or delete digital evidence crucial to the prosecution’s case if granted access to telecommunication devices outside custody.

The prosecution also expressed fears that the accused could interfere with potential witnesses, some of whom are former associates or employees of the affected institutions.

The court ordered that Komen be remanded at Capitol Hill Police Station pending rejoinder for issue of denial of bail
