A known businessman has been charged before a Nairobi court with allegedly obtaining over Sh93 million from four investors through purported land transactions in Nairobi’s Karen area.
Abdiwahab Sheikh Abdi appeared before Milimani Principal Magistrate Paul Mutai and denied four counts of obtaining money by false pretences contrary to Section 313 of the Penal Code.
The prosecution alleges that between August 2016 and April 2018, the accused fraudulently obtained a total of Sh93.5 million from four complainants after falsely claiming that he was in a position to sell them various parcels of land in Karen.
According to court documents, Abdi is accused of obtaining Sh26 million from Emmanuel Wangwe between October 31, 2017 and April 27, 2018 by allegedly misrepresenting that he could sell him Land Reference Number 13873/3 situated in Karen.
He is also accused of obtaining Sh25 million from Bernard Masaka Shinali between October 31, 2017 and April 26, 2018 under similar circumstances involving Land Reference Number 13873/9.
The court further heard that he allegedly obtained Sh26.5 million from Ben Kiptoo Ego between March 24, 2017 and August 2, 2017 after purporting to sell him Land Reference Number 13873/2.
Additionally, the businessman is accused of obtaining Sh16 million from Abdikadir Ali Ibrahim between August 23, 2016 and October 12, 2016 after allegedly claiming he could sell him Land Reference Number 13873/11.
The prosecution maintains that the representations made to the complainants were false and that the accused knew they were untrue.
Separately, Sheikh is facing another criminal case involving similar allegations.
In that matter, prosecutors accuse him of obtaining Sh18.7 million from Dr. Fatuma Ibrahim Adan between April 2017 and July 2019 by allegedly falsely claiming that he could sell her a Karen property identified as L.R. No. 13873/10.
He denied the charges in that case and was released on bond terms similar to those granted in the current proceedings.
Mutai released Abdi on a bond of Sh2 million with an alternative cash bail of Sh500,000 pending the hearing of the case.
