Angela Mulwa before court for Murder
The Directorate of Criminal Investigations (DCI) has moved to court seeking orders to detain lawyer Angela Mulwa for 14 days in order to complete investigations into the murder of Dr Victoria Nthunya Mutiso, alleging that she was present when Sh300,000 was paid as a down payment in an alleged plot to kill the former director.
In an application filed before the Milimani Law Courts, the DCI, through Corporal Romana Odour of the Homicide Investigations Bureau, alleges that Mulwa was present on April 24, 2026, during the payment of Sh300,000 in an alleged plan to have Dr Mutiso murdered, although the alleged plan later failed to materialise.
Milimani Resident Magistrate Joan Mati heard that Mulwa played a vital role in the subsequent murder of Dr Mutiso, who was fatally shot on July 29, 2026, in Upper Hill, Nairobi.
The application also alleges that Mulwa was present during the eviction and demolition of property L.R. No. 1504/13, which was at the centre of a land dispute involving the deceased.
Police further allege that she had been in constant communication with senior police officer Kenneth Sang, whose firearm was allegedly linked to the killing through preliminary ballistic investigations.
According to the application, investigators led by Odour recovered a Mini Jericho pistol, serial number 47302127, which was subjected to examination. The preliminary ballistic opinion allegedly linked cartridge cases and a bullet recovered during the investigations to the firearm.
Investigators further allege that the firearm had been issued to a senior police officer who remains at large.
The murder probe has also involved the recovery and examination of CCTV footage and call data records as investigators seek to piece together the circumstances surrounding Dr Mutiso’s killing.
Several motor vehicles, including KDJ 609D, in which Dr Mutiso was travelling at the time of the shooting, as well as motor vehicles KDH 600A and KDE 400W, have been detained for forensic examination. A motorcycle, registration number KMGZ 980D, is also being examined as part of the ongoing investigations.
Investigators are also examining the land dispute involving property L.R. No. 1504/13 as a possible motive behind the killing and whether the dispute may have had any connection to Dr Mutiso’s murder.
According to the application, Dr Mutiso had also reported an earlier incident before her death in which she was allegedly confronted by two armed people riding a motorcycle.
The incident allegedly occurred on July 7, 2026, while she was driving near Junction Mall along Ngong Road. She reportedly managed to flee and later made a report at Kilimani Police Station under OB No. 63/07/07/2026.
The DCI alleges that the respondent is suspected of being among the masterminds of the incident.
Investigators further told the court that the murder had initially been reported at Kibra Police Station before the Homicide Investigations Bureau at the DCI Headquarters took over the investigations.
The DCI told the court that investigations into the murder remain active, with several suspected participants still at large, while others are already in custody in connection with related miscellaneous applications before the Milimani Magistrate’s Court.
The investigators said they were pursuing additional leads and seeking to establish the role played by each of the suspected participants in the alleged plot and the subsequent killing.
In seeking Mulwa’s detention for 14 days, investigators argued that her release at this stage could lead to interference with witnesses, compromise ongoing investigations or result in collusion with other suspects who remain at large.
The DCI further argued that Mulwa was known to material witnesses, including members of the deceased’s family and persons connected with the land dispute, creating a risk of interference, intimidation or influence if she were released before investigations were concluded.
Police also cited the need to preserve the integrity of the ongoing investigations, arguing that suspects who remain at large could coordinate their accounts or interfere with documentary and electronic evidence.
Investigators are seeking more time to pursue outstanding leads and complete what they describe as technical investigations before submitting the file to the Director of Public Prosecutions for an independent decision on whether charges should be preferred.
The police also intend to merge the matter with investigations involving other suspects who are either in custody or still being pursued in connection with murder.
However, when the matter came before Milimani Resident Magistrate Joan Mati, the court directed that the preliminary objections raised in the matter be determined first.
A ruling on the preliminary objections is scheduled for Monday, August 24.
Pending the determination of the objections, the court directed that the bond terms granted in the related miscellaneous application shall remain in force.
The matter will proceed following the court’s determination on the preliminary objections.
