A Nairobi court has withdrawn examination malpractice charges against former Merishaw School Principal David Gideon Kariuki and the school’s employee, Alex Kataiyo Kasaine.
In her ruling, Milimani Principal Magistrate Daisy Mutai allowed an application by the prosecution to withdraw the charges under Section 87(a) of the Criminal Procedure Code.
“I will therefore allow the application to have the charges withdrawn under Section 87(a) of the Criminal Procedure Code,” the magistrate ruled.
The Director of Public Prosecutions (DPP) had earlier sought time to review the charges against the two.
The matter had been presented before the court on May 26, 2026, under a miscellaneous application, during which the prosecution informed the court that the DPP required 30 days to review the case.
According to the miscellaneous application filed in court, Kariuki, a former principal at Alliance Boys High School, and Kasaine, who served as the in-charge operator at the G-MAX Hall at Merishaw School, were to face charges of unlawfully disclosing examination material, namely English Paper 1 (101/1) Functional Writing Skills, during the administration of the 2025 Kenya Certificate of Secondary Education (KCSE) examination.
The prosecution had alleged that the two committed the offence on November 3, 2025, at Merishaw School in Isinya, Kajiado County, jointly with others not before the court, while serving as persons responsible for the administration and supervision of the KCSE examinations.
The duo was also set to face a charge of conspiracy to facilitate examination malpractice by allegedly interfering with the CCTV surveillance system with the intention of aiding examination projections.
