Five individuals, including two alleged members of the Kenya Defence Forces (KDF), have been arraigned in connection with a planned house break-in in Kitengela.
The accused, Charles Kiho Matata, David Ng’aa Mwangangi, Alex Mumo Kisilu, Richard Mwania Muasya, and Stella Nzuki Mweni appeared before Milimani Principal Magistrate Theresa Nyangena and denied the charges.
The five are alleged to have, between March 18 and March 25, 2026, conspired to commit a felony by planning to break into the house of George Okumu Opondo at Acacia Paradise Estate in Kitengela town.
The court heard that on March 25, 2026, at the same location, the five were found armed with dangerous weapons, including a claw bar, a claw hammer, a knife, and pliers, in circumstances indicating they intended to commit the offence of housebreaking.
The prosecution opposed the release of the first accused, Charles Kiho Matata, on bail, stating that he is a serving KDF sergeant currently facing active disciplinary proceedings within the military. The court was urged to instead release him to the Department of Defence headquarters to ensure his attendance in court.
A military police officer was present in court, and the prosecution requested that the accused persons be handed over accordingly.
In response, the defence did not dispute that Matata is a member of the defence forces but urged the court to grant him cash bail, stating that he would subsequently submit himself to the military disciplinary process.
The defence further requested lenient bail terms and asked the court to direct the Directorate of Criminal Investigations (DCI) to document the inventory and release the motor vehicle linked to the case.
The court however, released all the accused persons on a bond of Sh1 million each or an alternative cash bail of Sh500,000.
