A lawyer has been charged with stealing Sh49.4 million allegedly entrusted to him by a real estate company for the purchase of a parcel of land in Nairobi.
Ahmed Ally Ahmed appeared before Milimani Senior Principal Magistrate Theresia Nyangena and denied a charge of stealing by agent contrary to Section 283(b) of the Penal Code.
According to the charge sheet, Ahmed allegedly stole Sh49,400,500 belonging to Quba Real Estate Limited on diverse dates between November 16, 2023 and January 3, 2024.
The court heard that the money had been entrusted to Ahmed, who was allegedly acting as an agent of Quba Real Estate Limited, for payment for a parcel of land identified as Nairobi/Block/42/895, registered in the names of Julius Macharia Waweru and Eva Muthoni Waweru.
Ahmed, through his defence, however, disputed the circumstances surrounding the money, telling the court that the complainant and the accused had entered into an agreement.
The defence described the relationship between the parties as that of a lender and borrower, rather than an agency relationship as alleged by the prosecution.
The court was further told that the parties had entered into a settlement agreement which was supervised and witnessed by the Somali Council of Elders.
On its part, the Office of the Director of Public Prosecutions told the court that it had been served with a letter seeking to defer the plea.
The prosecution further indicated that Sh18 million had already been paid, while maintaining that Sh49 million remained outstanding.
The court granted Ahmed a bond of Sh10 million or an alternative cash bail of Sh2 million.
