A Nairobi court has cleared Mumias East MP Peter Salasya of hate speech charges after he complied with orders requiring him to conduct a 14-day peace campaign across his social media platforms.
Milimani Senior Principal Magistrate Paul Mutai, in his ruling, said the court was satisfied with evidence presented showing the legislator followed the directives issued earlier.
“I have seen the report filed by the Investigating Officer confirming compliance with the court order. From the report, the accused engaged in promoting peaceful coexistence and responsible use of media,” Magistrate Mutai ruled.
The court noted that Salasya’s social media peace campaign is ongoing and emphasized that such efforts must continue, allowing the withdrawal of the case, and ordered that the cash bail deposited by the MP be refunded.
The Director of Public Prosecutions (DPP) had sought to terminate the charges, indicating that an out-of-court resolution had been reached between Salasya and the National Cohesion and Integration Commission (NCIC).
Earlier, however, the court had raised concerns over lack of proof of compliance and directed that the MP and NCIC hold a joint, well-publicised conference at a venue to be communicated. Salasya was also instructed to actively promote messages of peace, cohesion, and national integration online and submit evidence of the campaign.
The application to withdraw the matter was made by the prosecution, Nora Achieng, who referenced the agreement between the two parties to settle the dispute outside court.
Salasya was arrested in May 2025 over allegations that he made inflammatory remarks during political rallies in Meru and Isiolo and while travelling toward Nanyuki. He was later charged with hate speech under the NCIC Act.
Court documents further alleged that on May 10, 2025, he posted inciteful remarks likely to fuel ethnic hostility on his verified X account, @pksalasya, at an undisclosed location within Kenya.
