A nominated Makueni MCA has been charged with cyber harassment over remarks he allegedly made on TikTok targeting Kibwezi West MP Mwengi Mutuse.
Urbanus Kyalo Wambua, a Wiper Party-nominated Member of CountyAssembly, appeared before Milimani Resident Magistrate Joan Mita and denied a charge of cyber harassment contrary to Section 27(1)(a), as read with Section 27(2) of the Computer Misuse and Cybercrimes Act.
The prosecution alleges that on August 5, 2026, at about 11pm, Wambua used his TikTok account, Hon Kanzala Kana Official, to publish a video in which he made remarks concerning Mutuse and other political leaders from the region.
According to the charge sheet, Wambua accused Mutuse of insulting Wiper Party leader Kalonzo Musyoka, the Makueni governor and the senator, while criticising other Makueni leaders for allegedly failing to speak out.
He also allegedly called on members of the Kamba community and Wiper supporters to confront leaders he considered opponents of the party, specifically referring to Mutuse as one of those he described as enemies of the political family.
The prosecution alleges that Wambua made the communication knowing, or having reason to know, that it was likely to cause Mutuse fear of violence.
Wambua’s defence urged the court to take judicial notice that the case was politically motivated, arguing that he had been arrested in Makueni and brought to Nairobi to face the charges, thereby raising questions about the court’s jurisdiction.
The defence also challenged the circumstances surrounding his arrest and prosecution, maintaining that the matter was a political charge.
The Director of Public Prosecutions did not oppose Wambua’s release on bail but told the court that there had been a surge in cases involving misuse of computers and social media, particularly among members of the political class.
The prosecution argued that the trend should be considered as an aggravating factor when dealing with the case.
Magistrate Joan Mita subsequently released Wambua on a Sh500,000 bond or an alternative cash bail of Sh200,000.
