A duo has been charged before a Nairobi court with obtaining coffee valued at Sh115 million by allegedly falsely pretending that the transaction was based on a genuine supply contract between two companies.
Peter Kimathi Kinyua and Ibet Torut appeared before Milimani Principal Magistrate Irene Thamara, where they denied the charges against them.
The two businessmen are accused of obtaining 2,383 bags of Kenya Arabia Coffee, each weighing 60 kilogrammes, from Peter Githinji Njuki in an alleged scheme said to have taken place between January 1 and January 24, 2024.
According to the charge sheet, the two allegedly acted jointly with another person who is already before the court.
They are accused of obtaining the coffee with the intention to defraud Njuki by falsely pretending that there was a genuine coffee supply contract between Servicoff Limited and Gilley Investment Limited.
The prosecution alleges that the purported contract, which was allegedly used as the basis for the transaction, was not genuine and that the accused persons knew the representation to be false.
The 2,383 bags of coffee, each weighing 60 kilogrammes, were valued at Sh115 million, according to the charge sheet.
Following their plea, the court released each of them on a bond of Sh700,000 or an alternative cash bail of Sh350,000.
The two will remain at liberty on the terms set by the court as the criminal case proceeds.
The matter will be mentioned on the 8th of September 2026.
