Two Remanded Over Assault and Death Threats as Court Orders Pre-Bail Report

A duo accused of assault and issuing death threats have been remanded at Parklands Police Station pending ruling on bond/bail terms on 30th March.

Rahiel Daud and Hitesh Motwani, also known as “Vicky,” were arraigned before Kibera Principal Magistrate Zainab Abdul, where they denied the charges against them.

The court heard that the two are accused of assaulting Arya Anuj at Taal Club in Westlands on March 25, 2026, causing him actual bodily harm. They also face a separate charge of allegedly threatening to kill the complainant during the same incident.

In her ruling, Magistrate Abdul noted that the first count is a serious offence carrying a heavy penalty. She directed that a pre-bail report be prepared before bond terms can be issued.

During proceedings, the defence raised concerns over the manner in which the accused were handled after their initial arrest. The court was told that the suspects had earlier been released on a Sh 5,000 cash bail at Parklands Police Station.

However, their lawyer claimed they later “went missing” under unclear circumstances, only to resurface in court. The defence further alleged possible interference with investigations, claiming officers from the Directorate of Criminal Investigations (DCI) may have taken an interest in the matter.

It was also alleged that the accused were taken to a location behind Capitol Hill Police Station and asked to record statements under unclear conditions.

The defence sought to have the plea deferred to establish the circumstances under which the statements were recorded and whether due process was followed.

However, the prosecution opposed the application, maintaining that the charges before the court were properly framed in line with Article 157 of the Constitution.

The prosecution further indicated that there is another pending matter involving the accused relating to malicious damage to property, but noted that only the current charges were ready for plea.

In her determination, Magistrate Abdul held that the prosecution could not have presented the charges in court without proper review, and directed that the plea proceed.
